Since January 1974, Arizona law has required all public and private employers with at least one employee to carry workers' compensation insurance. It is not required for an independent contractor, or a worker whose employment is both casual and not in the usual business of the employer. The law makes coverage optional for domestic servants.

The penalty is increased to $5,000 for a second offense and $10,000 for a third instance in a five-year period.
